Mr. Bharat Rajput, Advocate Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 13.10.2017 Heard.

1. This contempt petition has been filed alleging willful disobedience of order dated 21.07.2017 passed by this Court in WPS No.3239 of 2017.

2. Learned counsel for the petitioner submits that the decision has not been taken within the time stipulated by the Court.

3. Having gone through the various communications made, it is found that the proposal has already been made and decision has remained pending.

4. Vide memo dated 12.09.2017, the Divisional Forest Officer has forwarded the matter to the Chief Conservator of Forest, Regional Durg, Circle Durg. Therefore, in these circumstances, at present, I am not inclined to initiate any contempt proceeding.

5. The Chief Conservator and Forest, Regional Durg, Circle Durg shall do well

to pass necessary orders forth with because once the order is passed by the Court, it is not dependent upon approval of the any authority. If the appropriate order is not passed within a period of four weeks from the date of receipt of copy of the order of this Court, the petitioner would be at liberty to revive the contempt petition.

6. The contempt petition is disposed off.
