Hon'ble Shri Justice Goutam Bhaduri Order 19/02/2020 Heard.
1.
The petitioner contends that the husband of the petitioner was working as AG-III. He was appointed in the year 1985 and though it was ordered that one increment should have been given to the late husband, same was not granted, therefore instant petition for arrears by addition of the increment the benefit could have accrued. He refers to Annexure P-1 and would submit that already orders have been passed to grant one increment to the late husband, therefore the petitioner being widow would be entitled to get the benefit of the arrears. 2.
Perusal of the Annexure P-1 would show that order dated
16/09/2019 exist wherein the late husband K. Kirti Narayan Iyengar was allowed to be granted one increment after one year of his appointment. Consequently, as appears no dispute exist as on date with respect to the entitlement of the arrears of the payment by addition of the one increment and it has already been agreed by the State. Therefore under the circumstances, it is directed that the State authorities after verification of the facts and the date of appointment of the late husband of the petitioner shall comply its own order dated 16/09/2019 and the benefit be granted to the petitioner the widow within a period of 90 days from the date of receipt of copy of this order.
