Agrawal Order On Board 13/11/2017 (1) Learned counsel appearing for the petitioner would submit that the life of the impugned order dated 03.06.2008 (Annexure P/1) passed by respondent No.2-Managing Director, Chhattisgarh State Krishi Vipadan Board, Raipur against the petitioner has already been expired; and petitioner has further elected on the post of member of Zila Panchayat, Sukma. However, no further proceeding under Section 58 of the Chhattisgarh Krishi Upaj Mandi Adhiniyam, 1972 has been initiated against her till this date. He would further submit that if the proceeding is initiated against her, she may be granted liberty to challenge the same in accordance with law.

(2) Prayer appears to be fair and reasonable.

(3) If the proceeding is initiated against the petitioner under Section 58 of the Chhattisgarh Krishi Upaj Mandi Adhiniyam, 1972 pursuant to order dated 03.06.2008 (Annexure P/1), she would be at

liberty to avail the legal remedy available under the law. (4) With the aforesaid observation, the writ petition stands finally disposed of. No order as to costs.
