The reason for dismissal of the Petitioner from service of the Bank was his conviction by the CBI Court on charges of accepting bribe for which he was sentenced for a period of three years.

I have perused the order of dismissal passed by the Respondent-Bank. Since the dismissal is based on the ground of his conviction which is permissible and no enquiry is required separately for the same set of charges, the order of dismissal cannot be said to be erroneous. 4.
The writ application is dismissed, however, if the Petitioner stands acquitted in case he has preferred any appeal against the order of his conviction, then he may seek appropriate judicial remedy.
