Learned counsel for the petitioners submits that the petition is only preferred against rejection of an application which is filed as Annexure P-2 claiming 1/3rd of the amount deposited in the State Bank through C.C.D. and further prayer was made that the particulars of TDS deducted from time to time may also be provided. He submits that despite the application filed in the month of August, 2017, learned Court below has not decided the same and for the one reason or other adjourned the case without any sufficient reason; therefore, the trial Court may be directed to decide the application of the petitioner within a time limit. 2.

Considering the prayer made, since no order has been prayed on merit and only a prayer has been made to get an application adjudicated, the trial Court is requested to expedite the issue and to decide the application within a further period of 45 days from

the date of production of a copy of this order. It is further made clear that this Court has not made any observation on merit even about the maintainability of the application. 3.
