This is the first bail application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicants who have been arrested in connection with Crime No. 145/2015 registered at Police Station- Pandri, District - Raipur (C.G.) for the offence punishable under Sections 420, 467, 468, 471, 120 B of Indian Penal Code.

As per the prosecution case, in brief, is that the applicants in connivance with each other were running Shreya Job Placement

Agency and received certain amounts from different unemployed persons and gave them forged appointment letters and subsequently the appointment letter was found to be fake and certain cheques which were given as return of amount were bounced.

Counsel for the applicant would submit that the entire allegation of receipt of amount is against Sonia Banjare and she has received the amount thus, the applicants have not committed any offence. She further submits that the applicants have been falsely inculpated in this case, therefore, the applicant may be enlarged on bail.

Learned State counsel opposes the prayer for grant of bail. 5.

Perused the statement of Niranjan Prasad, one of the complainant which revealed that the certain amounts have been received by Sonia Banjare and the forged appointment letters were supplied by Sunita. Considering the fact that the bail application of similarly placed co-accused person namely Sonia Banjare has been dismissed by Coordinate Bench of this High Court and further taking into the fact that the cheques which were given to the complainants were dishonoured which was issued by Prashant Sharma and they were working in Shreya Job Placement Agency, taking the degree of allegation and statement, I am not inclined to allow this bail application.
