This is the first bail application filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of regular bail to the applicant, who has been arrested in connection with Crime No. 437/2015, registered at Police Station Saraipali, District Mahasamund, C.G., for the offence punishable under Sections 20(B), 27(A), 28 & 29 of the Narcotic Drugs and Psychotropic Substance Act.

After hearing learned counsel appearing for the parties and taking into consideration the facts and circumstances of the case; nature and gravity of offence; material available against the applicant and quantity of Ganja i.e. 70 Kg., this Court is not inclined to release the applicant on regular bail. 3.

Accordingly, bail application filed under Section 439 of the

Cr.P.C. is rejected.
