Agrawal Order On Board 29/06/2015 Heard (1) The accused/applicant has moved this bail application under Section 439 of the Code of Criminal Procedure for releasing him on regular bail during trial in connection with Crime No.97/2014 registered at Police Station Mohla, District Rajnandgaon for the offences punishable under Sections 363, 366 & 506 read with Section 34 of the Indian Penal Code.

(2) Case of the prosecution in brief is that on 28.11.2014 applicant abducted the complainant/victim namely Ku. Preeti Ghawde in order to compel her to marry with him against her will and also threatened her to kill and, thereby, committed the

aforesaid offences.

(3) Counsel for the applicant submits that the applicant has falsely been implicated in the offence in question as he has not committed the aforesaid offences. He further submits that applicant is in jail since 26.09.2015; charge sheet has already been filed and, therefore, the applicant may be released on bail. (4) On the other hand, learned counsel for the State submits that victim/complainant is school going girl and member of Scheduled Tribe community and the manner in which the offence is said to have been committed by the applicant, he is not entitled to be released on bail. (5) Looking to the nature and gravity of the offence; and the manner in which the applicant is said to have abducted the compliant/victim with the help of other co-accused with intention to compel her to marry with him against her will and also threatened her to kill, I am not inclined to release the applicant on bail. Therefore, the bail application is rejected.
