The petitioner through the instant writ petition has sought for limited relief of a direction to the respondent to consider and decide the permit application filed by the petitioner before the respondent vide Annexure P/1.

The grievances of the petitioner is that the petitioner is a private bus operator and he is plying his bus on the basis of regular and temporary permit granted by the transport authority. He further submits that for the route Raipur to Bijapur via Dhamtari, Kanker, Kondagaon vide Annexure P/1 dated 05.02.2015, he has already moved an application for grant of regular permit. However, even after more than 2 months time have passed the respondent has till date not taken any decision on his application and therefore, prays that respondent may be directed to decide his application on as earliest.

State counsel does not have any objection for the limited prayer made by the petitioner.

In view of the submission made by the State counsel, the writ petition is disposed of with a direction to respondent to decide the petitioner's application and other similar applications if any pending for the above referred route as expeditiously as possible. 5.
It is made clear that this Court has not expressed any opinion on the merit of the case and the respondent authority shall decide the matter on its own merit strictly in accordance of law. (P. Sam Koshy) JUDGE Santosh
