The present is an application under Section 438 of CrPC seeking for grant of anticipatory bail to the Applicant who is apprehending his arrest in connection with Crime No.321/2017, registered at Police StationTakhatpur, District- Bilaspur, for the offence punishable under Sections 406 and 420 of IPC.

Learned Counsel for the Applicant prays for withdrawal of the present anticipatory bail application, with a liberty that if the Applicant moves an application for grant of regular bail before the concerned Court below then the Court below may decide the said application on the same day.

The present application filed under Section 438 of CrPC stands accordingly dismissed as withdrawn. However, it is ordered that if the Applicant surrenders himself before the concerned Court below and moves an application for grant of regular bail then the same shall be decided by the said Court, if possible, on the same day, on its own merits, in accordance with law.
