The present is a repeat application filed under Section 439 of CrPC for grant of bail to the applicant who is in jail since 12.10.2017 in connection with Crime No. 499/2017 registered at Police Station Jamul, District Durg, for the offence punishable under Sections 377 and 506-B of IPC read with Section 4 of the POCSO Act.

The earlier bail application stood rejected by this Court vide order dated 16.4.2018 passed in M.Cr.C. No. 1575/2018. 3.
The present bail application has been filed by the applicant on the ground of delay and the applicant being remained in custody for a period of about 21⁄2 years.

Except for the ground of delay, there does not seem to be any substantial ground raised by the applicant for grant of bail at this juncture. 5.
Considering the facts and circumstances on which the earlier bail application was rejected and also taking note of the nature of offence committed by the applicant, this Court is of the opinion that no strong case for grant of bail is made out by the applicant at this juncture.

Accordingly, the M.Cr.C. is dismissed. However, the Trial Court is directed to take necessary steps for an early conclusion of the trial. Sd/- (P. Sam Koshy) /sharad/ Judge
