The limited grievance of the petitioner is that though the petitioner is eligible and fit for being regularized as one time measure under the circular dated 05-03-2008 issued by the State Government in compliance of the directions issued in by the Supreme Court in the case of Secretary, State of Karnataka and Others Vs. Uma Devi (3) and others, 2006 (4) SCC 1, he is not being regularized. It is also pointed out to this Court that in view of the fact that the petitioner's case for regularization was considered by the Scrutiny Committee and the Scrutiny Committee has also given favaourable recommendation even that is not being acted upon. 2.

learned counsel for the State assures this Court that competent authority shall examine the case of the petitioner under the circular dated 05-03-2008 and take decision on peitioner's regularization within a period

of 90 days. In view of the said submission, I am not inclined to keep this matter pending but to dispose off with a direction to respondent No. 2 to take appropriate decision in the matter within a period of 90 days from the date of receipt of receipt of copy of this order. 3.

Accordingly, the petition is disposed off.
