1. The applicant has preferred this application under Section 439 of Cr.P.C. as he has been arrested in connection with Crime No.74/2021 registered at Police Station Dabhara, District JanjgirChampa, C.G. for the offence punishable under Sections 34(2) of the C.G. Excise Act.

2. At the outset, learned counsel for the State submits that there are as many as three criminal antecedents against the present applicant.

3. In view of above, learned counsel for the applicant does not want to press this application and seeks to withdraw the same with liberty

to file afresh at the appropriate stage.

4. Accordingly, the bail application is dismissed as withdrawn with the liberty as stated above.
