Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 13/12/2017 Heard.

1. The applicant has been arrested in connection with Crime No.95 of 2017 registered at Police Station- Dhamdha, District Durg (CG) for the alleged commission of offence under Section 376 of IPC and Section 5 & 6 of POCSO Act.

2. Case of the prosecution is that the applicant enticed a minor girl and committed rape on her.

3. Case diary has been perused. 164 Cr.P.C. statement of the prosecutrix shows that the prosecutrix was subjected to rape by the applicant. Looking to the age of the prosecutrix as 17 years and 5 months as indicated, in the school records collected by the prosecution, I am not inclined to grant bail to the applicant.
