Hon'ble Shri Justice Goutam Bhaduri Order 13/06/2016 1.

The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No. 70/2014 registered in Police Station Janakpur, District Koria (C.G.) for offence punishable under sections 420, 409, 34 of Indian Penal Code.

As per the prosecution case, the applicant who is the Manager of Paddy Procurement Centre has purchased Paddy from the agriculturist over and above to their extent of limit which were prescribed according to their land holdings by manipulating certain land records along with the farmers, thereby has caused loss to the government ex-chequer. 3.

Learned counsel for the applicant submits that applicant has not committed any offence and all the documents have been seized and the charge sheet has been filed, no further investigation is needed and the applicant is in jail since 25/02/2016, therefore the applicant may be released on bail.

Learned State counsel opposes the prayer for grant of bail.

I have perused the case diary and the statement. Charge sheet has been filed. Considering the nature of allegations and taking into fact that all the evidence are documentary in nature, applicant is in jail since 25/02/2016, this court is inclined to release the applicant on bail. 6.

Accordingly, the bail application is allowed and it is directed that the applicant shall be released on his furnishing personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of concerned trial court for his regular appearance before it as and when directed.
