Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 31.10.2017 Heard.

1. Learned counsel for the petitioner submits that this case is squarely covered by the order dated 07.07.2015 passed in WPS No.217 of 2015 (Prakash Narayan Tiwari Vs. State of Chhattisgarh and others), which settled legal issue that after revocation from suspension the petitioner is entitled to be posted at the same place wherefrom he was suspended.

2. After going through the contents of the petition and also the order dated 07.07.2015 passed in WPS No.217 of 2015, I am not inclined to keep the matter pending as the legal position is set at rest.

3. Accordingly, this petition is also disposed off with a direction to respondents to consider petitioner's posting upon revocation of suspension in accordance with law laid down by this Court in the case of Prakash Narayan Tiwari (supra) within a period of 30 days from the date of receipt of copy of this order.
