Hon'ble Shri Justice P. Sam Koshy Order On Board 13/07/2015 This is the fourth bail application filed u/s 439 of Cr.P.C. for grant of bail to the applicant who was arrested on 24.09.2012 in connection with Crime No. 176/2012 registered at P.S. Bodla, District Kabirdham for the offence punishable under Sections 394, 395, 397 of IPC and 25 (1)(a) and 27 (2) of Arms Act.
First, second and third bail applications of the applicant were rejected by this Court vide order dated 16.06.2014, 26.08.2014 & 16.01.2015 respectively. While dismissing the third bail application vide order dated 16.01.2015, this Court had specifically directed the Court below to conclude the trial expeditiously. The documents filed along with this M.Cr.C. show that 27 prosecution witnesses have already been examined which itself establishes the fact that the trial is at the verge of its final conclusion. Thus, on this very ground, this Court is not inclined to grant bail to the applicant at this juncture. Accordingly, the present application filed under Section 439 of Cr.P.C. is dismissed.
However, it is expected that taking into consideration the fact that most of the prosecution witnesses have been examined, the trial Court shall conclude the trial at the earliest. Sd/- (P. Sam Koshy) Judge Bhola
