Agrawal Order On Board /0 4 /201 (1) The accused/applicant has moved this bail application under Section 439 of the Code of Criminal Procedure for releasing him on regular bail during trial in connection with Crime No. 577/2015 registered at Police Station Durg, Distt. Durg (C.g.) for the offences punishable under Sections 376, 506B of the Indian Penal Code and Section 4 of the Protection of Children from Sexual Offences Act. (2) After hearing learned counsel appearing for the parties, taking into consideration the facts & circumstances of the case and the manner in which the applicant is said to have raped the minor prosecutrix, aged 13 years, and the evidence available in the case diary; I am not inclined to release the applicant on bail. Thus, the bail application is rejected.
