The applicant has preferred this bail application under Section 439 of Cr.P.C. in connection with Crime No.101/2015 registered at Police Station Durg, District Durg (C.G.) for the offence punishable under Sections 363, 366, 376 of IPC and Sections 5(tha), 6 of Protection of Children from Sexual Offence Act.

The counsel for the applicant prays for withdrawal of the bail application with liberty to duly constituted the second bail application as the earlier bail application has been rejected by the co-ordinate Bench of this Court in M.Cr.C. No. 4562/2015 vide order dated 07/09/2015. 3.

Prayer is allowed.

Accordingly, present M.Cr.C. stands dismissed as withdrawn with the aforesaid liberty.
