Learned counsel for the respondent raised a preliminary objection by submitting that the order passed under Section 24 of the Hindu Marriage Act,1955 is appealable in view of order dated 25.6.2013 passed by this Court in W.P. (227) No.419 of 2013. Having perused the aforesaid order, the petitioner has a remedy of appeal. At this stage, learned counsel for the petitioner seeks to withdraw this petition with liberty to take remedy of appeal.

Accordingly, with the liberty as prayed for, the petition is dismissed as withdrawn. As prayed, certified copy of the impugned order be returned to the petitioner after retaining photocopy of the same.
