ORDER
(Passed on 08th September, 2018) 1.
The applicant has been convicted under Sections 338 of the IPC by the Judicial Magistrate First Class, Raigarh District Raigarh (C.G.) and the same is affirmed by the Second Additional Sessions Judge, Raigarh (C.G.) in Cr. Appeal No. 144 of 2001 vide impugned judgment dated 15.07.2002, wherein the applicant is sentenced to rigorous imprisonment for six months and to pay fine of Rs. 10,000/- for causing grievous hurt to complainant Manohardas and causing annoyance to him by using obscene words.

As all the offence is compoundable, therefore, with the permission of the Court, the offence is hereby compounded in view of Section 320(8) Cr.P.C.1973. The applicant is acquitted for commission of offence under Sections 338 of the IPC and conviction and sentence imposed upon the applicants by the trial Court is set aside.
