1. Heard on IA No. 01/2018, an application for condonation of delay in filing the restoration application.

2. On due consideration, IA No. 01/2018 is allowed.

3. Delay of 117 days in filing this MCC is condoned.

4. Also heard on this MCC which has been filed for restoration of F.A. No. 426/2017 which was directed to be dismissed vide order

dated 14.09.2017, if the default is not removed within two weeks.

5. For the reasons stated in the application, it is allowed and F.A.No. 426/2017 is directed to be restored to its original number subject to payment of cost of Rs. 1,000/- by the petitioner to the High Court Bar Association within a period of one week, failing which this order shall lose its efficacy.
