At the outset, it is submitted on behalf of the petitioner that the petitioner is simply praying by filing the instant WP(227) that Civil Suit No.4A/2014 (Dukalaha Ram Vs. Tikaram and antother) pending before the Civil Judge Clause I, Bhatapara, C.G. (old Civil Suit No.14A/11 and 2A/11 earlier pending before the Court of Civil Judge Class I, Bhatapara and Civil Judge Class II, Bhatapara, C.G.) may be disposed of within stipulated period and looking to the prayer, issuance of notice to respondent No.1 is not required. 2.

On due consideration, looking to the prayer as in the instant WP(227) regarding the disposal of the aforementioned civil suit within stipulated period, this Court is of the view that issuance of notice to respondent No.1 is not required.

Upon consideration of the entire facts, the instant WP(227) is disposed of. The Court below is directed to dispose of the aforementioned civil suit

pending as expeditiously as possible preferably within six months from next date of hearing.

The petitioner may file copy of this order before the Court below for compliance. Registrar (Judicial) is also directed to transmit copy of the order to the Court below for compliance through usual mode and fax mode, immediately.

The petition disposed of.
