Agrawal Order on Board 1 1 /0 4 /201 (1) The accused/applicant has moved this bail application under Section 439 of the Code of Criminal Procedure for releasing him on regular bail during trial in connection with Crime No. 592/2015 registered at Police Station Dongargarh for the offences punishable under Sections 452, 354 & 376 of the Indian Penal Code. (2) After hearing learned counsel appearing for the parties; taking into consideration the facts & circumstances of the case; looking to the nature & gravity of the offence and the manner in which on 18.11.2015 applicant is said to have committed sexual intercourse with the prosecutrix against her will; prompt lodging of the FIR and the statement of the prosecution witnesses and other material available on record against the applicant, I am not inclined to release the applicant on bail.
