Heard on application for grant of leave to appeal filed by the State. 2.
Taking into consideration the submission of learned counsel for the petitioner, the learned trial Court, having record a finding that the prosecutrix was minor and that she was subject to sexual intercourse dis-believed, only on account of non-examination of some other witnesses, we are inclined to grant leave to appeal.

Accordingly, the CRMP is allowed and the case to be registered as an acquittal appeal and be listed for further orders.

CRMP is disposed off.
