NAFR HIGH COURT OF CHHATTISGARH, BILASPUR WPS No. 5921 of 2017

1. Rudramani Gabel S/o Shri Ramnath Gabel, Aged About 29 Years R/o Ward No. 3, Kachhari Para, Bemetara, District Bemetara.

2. Shailendra Jaiswal S/o Shri Narsingh Jaiswal, Aged About 28 Years R/o Modbhatta Road, Ward No. 6, Bemetara, District Bemetara.

---- Petitioners

Versus

1. State Of Chhattisgarh Through The Secretary, Ministry of Panchayat Rural Development And Labour, Mantralaya, Mahanadi Bhawan, Naya Raipur.

2. Development Commissioner, Indrawati Bhawan, Block - I, Room No. 43, (CIV), Ground Floor, Naya Raipur, Chhattisgarh. ---- Respondents For Petitioners :

Ms. Sharmila Singhai, Advocate.

For State :

Mr. Avinash Singh, Panel Lawyer Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board /11/2017 Heard.

1.

The petitioners, by this petition, are praying for issuance of mandamus to respondents to grant them some relaxation on the ground that the petitioners having worked as Panchayat Secretary are entitled to weightage. It is submitted that weightage of 15 marks has been given to those candidates, who were possessed of Post Graduate Diploma or Post Graduate Degree in Rural Development.

2.

Learned counsel for the petitioners could not point out that there is any such scheme of relaxation under the Recruitment Rules or the policy under which the recruitments have been made. Whether or not relaxation should be

given for having obtained working experience on any other post, is essentially in the realm of policy making. Relaxation of 15 marks have been granted to a class of candidates on the basis of qualification and not on the basis of experience gained on any other public post. Therefore, in these circumstances, no direction can be issued.

3.

It would, however, be open for the petitioners to represent the competent authority to consider their claim of relaxation on the ground of they being possessed of experience of having worked as Panchayat Secretary. 4.

Accordingly, the petition is disposed off.
