1. The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.135/2019 registered in Police Station Lundra, District Surguja for offence under Sections 302, 147, 148, 149 and 323 of the IPC.
2. As per the FIR lodged by Vishnu Yadav, who is an eyewitness, as also in the statements of other eyewitnesses namely, Girvar Yadav and Suresh Pawle, initially Sunil Singh assaulted the deceased by means of spade, but later on other accused persons including the present applicant had also taken part in the assault.
3. Considering the eyewitness account, this Court is not inclined to release the
applicant on bail. Accordingly, the application is rejected. However, liberty is reserved in favour of the applicant to move again after examination of eyewitnesses.
