The applicant has been arrested in connection with Crime No.341/2017 registered at Police Station - Kotwali, Ambikapur, Distt. - Surguja (CG) for alleged commission of offences under Section 454, 380 of IPC. 2.

Case of the prosecution is that the applicant stolen electric wires from the shop.

Learned counsel for the applicant submits that the applicant has been falsely implicated and false seizure has been prepared against him. It is submitted that the applicant has not committed any offence. He would submit that investigation is complete, charge sheet has been filed, therefore, at this stage, the applicant may be granted bail.

On the other hand, learned State counsel opposes bail application and submits that as per the seizure memo some bundles of wire was seized from the applicant. Therefore, prima facie case is made out.

Taking into consideration the submission of learned counsel for the parties, nature of allegations and the articles alleged to be stolen by the applicant and considering that investigation is complete, charge sheet has been filed, applicant is not likely to abscond or tamper with the prosecution witnesses and having no criminal antecedent, I am inclined to grant bail to the applicant. 6.

Accordingly, the application is allowed. It is directed that the applicant shall be released on bail on furnishing a personal bond in the sum of Rs.25,000/- along with one local surety for the like amount to the satisfaction of the Trial Court. He shall appear before the Trial Court regularly on each and every date, unless exempted from appearance.
