2. The petitioner has been removed from the ofÏce of Sarpanch, Gram Panchayat Gaduva, Janpad Panchayat Saja, District Bemetara on the ground that he has not convened the meeting of the Gram Sabha as required under the C.G. Panchayat Raj
Adhiniyam, 1993.
3. Admittedly, the petitioner has already preferred an appeal before the Collector, Bemetara wherein, initially, he was granted interim order but subsequently, the interim order was vacated, however, the appeal is yet to be considered on merits.
4. Considering the fact that the appeal is pending before the Collector, Bemetar, the writ petition is disposed of with direction that the Collector, Bemetara shall decide the appeal within 6 weeks from today. During this period, the petitioner shall be allowed to continue as Sarpanch of Gram Panchayat, Gaduva.
