1. This is an application filed under Section 439 Cr.P.C. for grant of bail to the applicant, who has been arrested in connection with Crime No. 30/2017 registered at Police Station Odgi, District Surajpur, Chhattisgarh for the offence punishable under Sections 409, 420 of Indian Penal Code.

2. The present applicant is in jail since 30.05.2017 in connection with the aforesaid Crime number.

3. The allegation against the present applicant as per the case of prosecution is that in the capacity of a Branch Postmaster, the present applicant is said to have received money from the customers for investment in their account, but the said amount were either not entered in the register and the money was retained by the applicant and in certain cases he has provided a receipt to the customers, but the entry still has not been made in the register and thus in the course has collected huge amount of money.

4. Counsel for the applicant submits that considering the period of custody already undergone and the fact that the charge sheet has already been filed, prayed for the applicant to be released on bail.

5. The State counsel however opposes the bail application on the ground that there are serious allegations against the present applicant and that there are sufficient evidence to show that he had committed the offence including the admission on the part of the present applicant himself and thus prayed for rejection of the bail application.

6. Given the facts and circumstances of the case, particularly considering the nature of the allegation, this Court does not find any case for grant of bail.
