Bilaspur, C.G. ---- Applicant
Versus
State Of Chhattisgarh Through: The Station House Officer, Police Station Jashpur District Jashpur, C.G.
---- Respondent For Applicant :
Dr. N.K.Shukla, senior counsel along with Shri Shailendra Shukla, counsel for the applicant. For Respondent / State :
Shri R.K.Gupta, Dy.A.G.
Order On Board 23/07/2015 Heard.
The applicant is apprehending his arrest in connection with Crime No.269/14 registered at police station - Jashpur, Distt. Jashpur (CG) for alleged commission of offence under Section 420, 467, 468 & 471 read with Section 34 of IPC. 2.
Case of the prosecution is that the password was stolen and thereafter, huge amount was transferred to the account of the applicant without there being any bills submitted and passed by the competent authority between the period from 29/07/12 to 16/12/13.
3.
Learned senior counsel submits that the applicant had no role to play in the alleged offence. He submits that he does not know how this amount was transferred to his account through on-line banking system. According to him, as soon the applicant came to know about this, he repaid the amount to the department. 4.
On the other hand, learned State counsel opposes the bail application and submits that the material so far collected shows that the password was stolen and
huge amount was transferred over a period from 29/07/12 to 16/12/13 in the account of the applicant which prima facie shows that it was the applicant who was involved in this criminal activity.
5.
Considering the submission of learned counsel for the parties and nature of allegations, I am not inclined to grant bail to the applicant. The application is therefore rejected.
