The limited grievance of the petitioners in the present writ petition is the inaction on the part of the respondents in not considering the
claim of the petitioners for promotion from the post of Training Officer to the post of Training Superintendent.

According to the petitioners, they were appointed in the year 2013 and as per the Rules governing the field, the petitioners have become eligible for promotion to the post of Training Superintendent on completion of 6 years of service. The petitioners herein became eligible for promotion in the year 2019. The counsel for the petitioners further submits that as on date there are more than 124 posts of Training Superintendent lying vacant in the Department and in the event if the Department convenes the DPC for filling up of the said posts, the petitioners being eligible can be considered against the said posts.
The Chhattisgarh Public Service (Promotion) Rules of 2003 specifically envisages that the Department or the Government should ensure that DPC are held regularly atleast once in a year so that the promotional posts are filled up periodically and ensuring that the persons in the feeder posts get a chance of being promoted frequently. According to the petitioners, for the past many years, there has been no DPC convened by the respondents for filling up of the post of Training Superintendent.

Given the said submissions by the counsel for the petitioners, in the interest of the petitioners the matter can be disposed of directing the respondents No.1 & 2 to take an appropriate decision in respect of the claim of the petitioners for promotion by taking a decision so far as convening a DPC at the earliest in terms of the Chhattisgarh Public Service (Promotion) Rules of 2003. Let an administrative
decision in this regard be taken at the earliest preferably within a period of 4 months from the date of receipt of the copy of this order. 4.
With the aforesaid observations, the present writ petition stands disposed of.
