1. At the outset, learned counsel for the petitioner submits that in view of subsequent events during the pendency of the petition that the petitioner has been promoted, the only issue now remains for consideration is grant of seniority from due date.
In view of what has been averred in the return, learned counsel for the petitioner submits that at this stage, the petition may be disposed off with liberty to the respondents to examine petitioner's claim of seniority from due date.
2. Learned counsel for the State submits that if any such direction is issued, respondent shall consider and take decision in accordance with law.
3. In view of the stand so taken by learned counsel for the parties and that the petitioner has already received promotion during pendency of the petition, it would be expedient at this stage to dispose off the matter with a direction to respondent-State to consider petitioner's remaining grievance of seniority from
-2due date in accordance with law, preferably within a period of 12 weeks from the date of receipt of copy of this order.
