NAFR HIGH COURT OF CHHATTISGARH, BILASPUR Writ Petition (L) No.4355 of 2009 M/s Balaje Steel Industries, Proprietor M/s Balaji Agro (Agro Equipment Pvt. Ltd.) 205 220 Ulra Industrial Area, Raipur, through its General Manager (Account), Raipur, Chhattisgarh ---- Petitioner versus Regional Provident Fund Commissioner-II, Indira Gandhi Vyavasaik Parisar Block - D, Scheme No.32 Pandri, Raipur, Chhattisgarh ---- Respondent For Petitioner :
Shri N.K. Vyas, Advocate For Respondent :
Shri Pradeep Saxena, Advocate Hon'ble Shri Navin Sinha, Chief Justice Order on Board 16/10/2015 1.
Heard Learned Counsel for the Petitioner and the Respondent. 2.
Learned Counsel for the Petitioner submits that with regard to the demand for the same period the authorities issued two separate claims notwithstanding the fact that the dues inclusive of damages and interest had already been deposited. There was thus no justification for attaching the bank account for non-compliance. The Petitioner has filed an application on 30.6.2008 for withdrawal of attachment.
3.
Learned Counsel for the Respondent submits that the order is appealable.
4.
If the Petitioner has filed any representation claiming that the demand along with damages and interest has already been deposited and according to him the attachment had been ordered inadvertently for the same period, it is expected that this question of fact shall be examined by the authorities and disposed by a reasoned and speaking order.
5.
The writ application stands disposed.
