The Petitioner is stated to be an Assistant Teacher (Municipal) having qualification in commerce subject. There is 50% quota for promotion to the post of Teacher (Municipal) and thereafter to Lecturer (Municipal). The grievance is that the rules at the present do not recognise commerce qualification which renders the Petitioner ineligible to be considered for promotion to the post of Teacher (Municipal). Reliance is placed on an order in Writ Petition (S) No.661 of 2014 noticing the submission on behalf of the Respondents that on 28.10.2014 they have recognised commerce as a qualification for promotion from the post of Assistant Teacher (Panchayat) to Teacher (Panchayat). The submission therefore is that the Petitioner is also entitled to be considered for promotion after recognising her commerce qualification.

Learned Additional Advocate General submits that the matter for amendment of rules incorporating commerce as a recognised qualification is under process. If necessary amendment is made, eligible will be considered against promotional quota in accordance with law. 3.
