This petition has been filed by the petitioner against show cause notice dated 23-12-2015 (Annexure P-1).

Learned counsel for petitioner submits that the petitioner is holder of parcel of land ad measuring 0.03 acres under a valid lease granted by the Collector. It is submitted that the lease of the petitioner still subsists, even then, on the false allegation of having encroached upon the government land situated

in Plot No.2052/1, show cause notice has been issued. 4.

The petition is pre-mature. The petitioner has been given show cause notice and if say of the petitioner is that he has not encroached upon the government land, as stated in the show cause notice and that during the pendency of his application for grant of lease of that parcel of land, his application is pending before the Collector, no action can be taken, he is required to submit his reply raising all defence before the Nayab Tahsildar, Ambikapur, if not already filed.

Reserving liberty to the petitioner to raise his defence or submit reply to the show cause notice before the Nayab Tahsildar, Ambikapur, this petition is dismissed.
