1. The accused/applicant has moved this bail application under Section 439 of the Code of Criminal Procedure, 1973 for releasing him on regular bail during trial in connection with Crime No.426/2015, registered at Police Station Sarkanda, Bilaspur, Distt. Bilaspur, for the offence punishable under Sections 452, 354, 354D of the IPC; Sections 7 and 8 of the Protection of Children from Sexual Offences Act, 2012.
2. The applicant was granted bail on 9-9-2015, thereafter on the date fixed for hearing i.e. 22-2-2016, he made default in appearance and as such, he has filed application for condonation of his absence on 22-2-2016 which was rejected and he was arrested on 14-3-2016.
3. After hearing counsel for the parties, the reason assigned for absence of the applicant on 22-2-2016 appears to be bona fide and therefore, the application for grant of bail is allowed.
4. It is, therefore, directed that the applicant be released on bail on his furnishing a personal bond in the sum of Rs.25,000/- with one surety in the like sum to the satisfaction of the concerned Court for his appearance as and when directed.
