The applicant has preferred this bail application under Section 439 of the CrPC, as he has been arrested in connection with Crime No.326/2019, registered at Police Station Bhilai Nagar, District Durg for the offence punishable under Section 302 of IPC. 2.

In a dispute arising out of outraging the modesty of applicant's girlfriend Sanjana Nishad, he committed murder of deceased Kailash Gupta @ Raja by inflicting knife blows. 3.

Admittedly, Sanjana Nishad and one Deva Sagar are the eye witnesses who have seen the occurrence.

Considering the eye witness account of the incident, this Court is

not inclined to release the applicant on bail. Accordingly, the bail application is dismissed, however, the applicant would be at liberty to move afresh after examination of the eye witnesses. Sd/- Prashant Kumar Mishra Judge Nirala
