The present writ petition has been filed seeking for the following relief:

10.1.

That, this Hon'ble Court may kindly be pleased to call for the entire record pertaining to the case of respondent No.5 from the office of respondent No.2 to 4 by issuing a writ of certiorari and after perusal of record, may kindly be pleased to direct the respondent No.1 to take action on the representations made by the petitioner (Annexure P/2, 3 & 4) and to proceed further against the respondent No.5 in terms of CCA Rules, 1966."

Prima facie, this Court is of the opinion that the writ petition would not be maintainable for the reason that the present writ petition has not been filed against any inaction on the part of the respondents towards the petitioner therein, nor is it a case where any of the rights

of the petitioner is getting adversely affected, so as to bring the petitioner within the ambit of an aggrieved person by which he could file the writ petition before this Court.

In the absence of which, the writ petition at this juncture in the given form would not be maintainable seeking an action against some XYZ third party, by way of a writ petition filed by a person, whose service conditions have not been in any manner adversely affected by any of the action on the part of the respondents or for that matter in the granting of the relief as prayed for.

The writ petition for the said ground of locus stands rejected, however the liberty would always be open for the petitioner to avail appropriate other remedies open to him in accordance with Rules. Sd/- (P. Sam Koshy) Judge Ved
