1. Heard.

2. This is the first bail application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant who has been arrested in connection with Crime No. 521/2019 registered at Police StationDongargarh, Dist Rajnandgaon (C.G.) for the offence punishable under Section 420, 467, 468, 471, 34, 120-b of the Indian Penal Code.

As per the prosecution case while loan under Kisan Credit Card was being advanced by Punjab National Bank, certain documents of land were deposited and when the default was committed, notices were given by the bank officers it was found that false personification and false documents have been made and the allegation has been attributed to the present applicant as he was the mastermind and even in the name of deceased

persons the document were prepared and loan was taken.

4. Learned counsel for the applicant submits that the applicant was only the broker at the behest of the Bank officers. He further submits that certain person were introduced to the bank by the present applicant so as to advance the loan. He further submits the entire fraud has been played by the Bank Officers and instead allegations have been attributed to the applicant, therefore, the present applicant may be released on bail.

5. Learned State counsel opposes the argument and submits that investigation is going on against the applicant who is the master mind of the entire fraud committed on the bank.

6. Considering the nature of the allegation and the fact that investigation is going on, I am not inclined to release the applicant on bail.

7. Accordingly, the bail application filed under Section 439 of Cr.P.C. is rejected.
