Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 01/04/2016 Heard.

1. This petition has been filed by the petitioner claiming that he has been alloted

-2about one acre of land for growing fruit bearing trees. It is the allegation of the petitioner that respondent No.6 is interfering with the possession and is cutting trees.

2. The petitioner has placed on record resolution of the Gram Panchayat but there is no order of allotment placed on record to show that the land was granted to the petitioner by way of lease by any competent revenue authority.

3. If the petitioner claims that he has been alloted land under the provision of the Land Revenue Code by any competent revenue authority, the petitioner's remedy lies in approaching that authority who granted him the land with request to take action against respondent No.6.

4. I find that the petitioner has preferred representation before the Collector. The Sub Divisional Officer (Revenue), Rajnandgaon shall verify the records with regard to the possession of the land in dispute and take appropriate steps on petitioner's application, if any such application is moved by the petitioner before it within a period of 30 days from today.
