This is the first bail application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant who has been arrested in connection with Crime No. 05/2020 registered at Police Station- Baghbahra, District Mahasamund (C.G.) for the offence punishable under Sections 420, 409, 406 of Indian Penal Code.

As per the prosecution case, the applicant felicitated in opening the bank account of the complainant namely Gour Singh Dhrv on 05/12/2017 and kept the pass-book and ATM card with him, and thereafter, when the money from the government account was deposited in the account, he gave Rs. 10,000/- to the complainant and kept Rs. 90,000/- with him.

Learned counsel for the applicant submits that the chargesheet has already been filed and the applicant is in jail since 10/01/2020 and no further investigation is required. 5.
Considering the facts that the present applicant is in jail since 10/01/2020 and the chargesheet has already been filed and no further investigation is required, I am inclined to release the applicant on bail.

Accordingly, the bail application filed under Section 439 of the Cr.P.C. is allowed.

It is directed that the applicant shall be released on bail on his furnishing a personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of the concerned trial Court, for his appearance as and when directed. Sd/- (Goutam Bhaduri) Judge Vishakha
