This is the first bail application filed under Section 439 of CrPC for grant of regular bail to the applicant, who has been arrested in connection with Crime No. 118/2020 registered in Police Station Dharamjaigarh Distt. Raigarh (C.G.) for offence punishable under Section 379/34 of Indian Penal Code.

As per the prosecution case, on 03.07.2020, a complaint was made by one Sattu Ram Yadav that he withdrew Rs.39,000/- from the Bank, kept it in the bag on the motorcycle and went to purchase some medicines. When he came back to his motorcycle, the said amount of Rs.39,000/- was stolen. Thereafter, on the basis of memorandum, the applicant was arrested on 15.12.2020 and an amount of Rs.8,000/- was recovered from his possession.

Learned counsel for the applicant submits that only on the basis of memorandum, the applicant has been arrested on 15.12.2020, chargesheet has already been filed, no further investigation is necessary, therefore, he may be enlarged on bail. 4.

Learned State opposes the submission made by learned counsel for the applicant.

Taking into consideration the nature of allegation in this case, the fact that the chargesheet has already been filed, the applicant is in jail since 15.12.2020, I am

inclined to release the applicant on bail. Accordingly, the bail application is allowed and it is directed that the applicant shall be released on his furnishing personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of concerned trial court for his regular appearance before it as and when directed.
