This is the first bail application filed under Section 439 of the Code of Criminal Procedure, for grant of bail to the applicant whose application for bail was rejected by Special Judge under the Electricity Board, 2003 vide order dated 07.11.2017 in Special Criminal Case No.612/2009 as he was arrested in connection with Crime No.145/2009 registered in Police Station Chakradhar Nagar, Distt. Raigarh (CG) for the offence under Section 135 of the Electricity Act.

The applicant had engaged the counsel for his representation before the said Court, but due to non-appearance of the applicant, arrest warrant was issued against him and after his arrest, he was sent to jail. He is the resident of Subhash
Chowk, Raigarh and he will abide all the directions of the Court, if granted bail.

Learned counsel for the State opposed the bail application. 4.
I have perused the case diary.

Taking into consideration that the applicant was earlier released on bail by the trial court and presently he is in custody since 03.11.2017, this is fit case to grant bail to the applicant. 6.
Accordingly, bail application filed under Section 439 CrPC is hereby allowed.

It is directed that the applicant shall be released on bail on his furnishing a persons bond for a sum of Rs.20,000/- with one surety in the like sum amount to the satisfaction of the concerned trial Court, for his appearance as and when directed. Sd/- (Ram Prasanna Sharma) JUDGE Bini
