The applicant has preferred this bail application under Section 439 of the CrPC, as he has been arrested in connection with Crime No.142/2019, registered at Police Station Kotwali, District Raipur for the offence punishable under Sections 436 & 302 (Five Times) of IPC.

The applicant and the co-accused Lohara set ablaze the house of the deceased Sujit Deep, Savita Deep, Priya Deep, Lakshya Deep and Kavya Deep in the night of 09.03.2019. While Sujit Deep died on the spot, the other deceased persons died in hospital. In the dying declaration of Priya Deep, she has clearly named the present applicant as one of the culprits.

Considering that the applicant and co-accused have committed murder of 5 persons by setting the house on fire, this Court is not inclined to grant benefit of regular bail to the applicant. 4.
