The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No. 15/2020 registered in Police Station Utai, District Durg C.G. for offence punishable under sections 452 & 354, 354(a) of IPC and Section 7 & 8 of POCSO Act. 2.

As per the prosecution case, on 14/01/2020 the prosecutrix who was minor aged about 17 years made a report that the applicant entered in the house closed the door and thereafter pressed her breast, thereby tried to outrage her modesty.

Learned counsel for the applicant submits that the applicant is in jail since 16/01/2020, charge sheet has been filed, no further investigation is necessary, therefore the applicant may be released on bail. 4.

Learned State counsel opposes the argument and read out the statement of the prosecutrix.

Considering the nature of allegation, charge sheet has been filed and the applicant is in jail since 16/01/2020, this court is inclined to

release the applicant on bail.

Accordingly, the bail application is allowed and it is directed that the applicant shall be released on his furnishing personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of concerned trial court for his regular appearance before it as and when directed.
