The present writ petition seems to be on the inaction on the part of the respondents in not dropping the disciplinary proceeding that has been initiated against the petitioner, particularly in the light of the petitioner getting acquitted in the criminal case, for which he was subsequently issued with a departmental charge-sheet and was facing a disciplinary proceedings.

It appears that against the issuance of charge-sheet, the petitioner has already preferred a writ petition i.e. WPS No. 5534/2017 and the writ petition is still pending consideration before this Court and the petitioner already has an interim protection from further proceedings with the departmental enquiry.

Given the facts and circumstances of the case, the present writ petition therefore would not be maintainable and the petitioner would be at liberty to take appropriate recourse by moving appropriate applications in the aforementioned pending writ petition.

With the aforesaid liberty, the present writ petition stands dismissed as not maintainable.
