Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 27/11/2017 The petitioner has filed this petition because of pendency of an enquiry and repeated issuance of notice on certain complaints with regard to petitioner's eligibility for appointment as land oustee.

Learned counsel for the petitioner submits that according to the petitioner, though her appointment is in accordance with the rehabilitation policy and there is nothing wrong, there are certain frivolous complaints made and time and again, notices were issued to the petitioner.

The petitioner has submitted information and documents as and when asked from the petitioner, but time and again, new notices have been issued, which is an
act of harassment.

I find, certain notices were issued to the petitioner requiring information and the petitioner has submitted information. According to the petitioner, last notice again demands those very documents which were already submitted by the petitioner.

It appears that before taking any decision against the petitioner, the respondents have been issuing notices seeking the petitioner to submit documents and information contained in the notice. If according to the petitioner, he has submitted all the information, the respondents should now take decision in the matter.

The respondent authority shall take appropriate decision in accordance with law on the basis of material submitted by the petitioner within a period of 60 days from the date of receipt of copy of this order. 7.
The petition is accordingly disposed off.
