(2) Learned counsel appearing for the State/respondents submits that the impugned orders dated 15.01.2016 (Annexure

P/1) & 02.02.2016 (Annexure P/2) is appealable before the respondent No.2- Collector, Kabirdham.

(3) At this stage, learned counsel appearing for the petitioner submits that the petitioner may be permitted to withdraw the instant writ petition with liberty to prefer an appeal before the respondent No.2-Collector, Kabirdham within a period of two weeks from today.

(4) The prayer appears to be fair and reasonable. (5) The writ petition is accordingly disposed of with a direction to the petitioner to prefer an appeal before the respondent No.2Collector, Kabirdham. If such appeal is filed by the petitioner within a period of two weeks from today and, in turn, the respondent No.2 shall consider and decide the same in accordance with law and on its own merit preferably within a period of three months from date of receipt of appeal along with copy of this order.
