Hon'ble Shri Justice P. Sam Koshy Order On Board 13/12/2017 Both the applications have been filed u/s 439 of Cr.P.C. for grant of bail to the applicants who have been arrested in connection with Crime No. 171/2017 registered at Police Station Than Khamriya, District Bemetara (CG) for the offence punishable under Section 304-B of IPC. Applicant Smt. Malti Sahu is in jail since 17.10.2017 and applicant Smt. Ranu Sahu is in jail since 06.11.2017.

The allegation, as per the prosecution case, against the the present applicants is that they along with other accused are said to have been subjecting the deceased ill-treatment, torture and cruelty which compelled her to commit suicide by setting herself ablaze on 11.10.2017. 3.
Counsel for the applicants submits that it is a case where the applicants have been falsely implicated in the instant case and that there is no specific allegation against them. All the averments which have come in the course of investigation are of general and omnibus with no specific overtact or any specific details. Thus, prayed for the applicants to be released on bail.

State counsel, however, opposes the bail application on the ground that the statements of the family members of the deceased recorded during the course of investigation reflect that there was a continuous ill-treatment, torture and assault by the husband and other family members on account of demand of dowry which ultimately led her committing suicide on 11.10.2017.

Given the facts and circumstances of the case, particularly taking note of the statement of the relatives of the deceased wherein, prima facie, it appears that the allegations are all omnibus and general with no specific overtact of each of the applicants, this Court is of the opinion that it is a fit case for grant of bail to the applicants.

Accordingly, the application for grant of bail is allowed. It is directed that the Applicants will be released on bail on their furnishing a personal bond in the sum of Rs.25,000/- with one surety each in the like sum to the satisfaction of the concerned trial Court for their appearance before the said Court as and when directed.
